Auckland Card Show – Vendor Terms and Conditions

These Terms and Conditions (“Agreement”) are entered into by and between the undersigned vendor (“Vendor”) and the Auckland Card Show (“Organizer”). By applying and participating in the Auckland Card Show, the Vendor agrees to the following terms:

 

1. Anti-Piracy Policy

  • Auckland Card Show has a strict anti-piracy policy. Vendors displaying counterfeit, pirated, or fan-made products that may infringe copyright will be required to remove these items and may be asked to leave the event without a refund.

  • Vendors are expected to adhere to the highest ethical standards when selecting products for sale. If unsure about the legitimacy of any product, vendors should contact the Organizer prior to the event for guidance.

  • Vendors must display no less than 75% trading or collectible card products or related products (e.g., sleeves, binders, etc.). Any product that deviates significantly from this requirement may be subject to removal from the event.

2. Booth Space and Setup

  • Booth Allocation: The Organizer will assign booth spaces based on availability and Vendor requirements. Specific booth requests will be considered but are not guaranteed.

  • Setup and Load-In: Vendors are responsible for setting up their booths during the designated setup times. Vendors must ensure their booth is ready before the official opening time of the event. Specific setup times will be provided by the Organizer.

  • Booth Hours: Vendors must ensure their booth is staffed and open during all official show hours. Early closure of booths is not permitted.

  • Booth Design: Vendors are responsible for the design and arrangement of their booth, provided it complies with the venue's fire safety regulations and overall event aesthetics.

3. Liability and Insurance

  • The Vendor is solely responsible for any loss, damage, or injury to their property, goods, staff, and customers during the event. Auckland Card Show and its representatives are not liable for any incidents arising from vendor activities.

  • Personal Property: The Vendor agrees to accept full responsibility for all materials and goods displayed at the booth and accepts liability for any damage, theft, or loss of items during the event.

  • Indemnification: The Vendor agrees to indemnify, defend, and hold harmless Auckland Card Show, its representatives, volunteers, agents, and employees from any claims, damages, or liabilities resulting from the Vendor’s actions, omissions, or negligence during the event.

  • Insurance: It is strongly recommended that all vendors carry their own insurance covering loss, theft, or damage to their products, equipment, and other property during the event.

4. Compliance with Laws and Regulations

  • Legal Compliance: Vendors must comply with all applicable laws, regulations, and codes, including, but not limited to, fire codes, health and safety regulations, and local zoning laws. The Organizer reserves the right to remove any vendor who violates these regulations or creates a safety hazard.

  • Taxation and Licensing: The Vendor is responsible for collecting and remitting any applicable taxes (e.g., sales tax) as required by local authorities. Vendors are also responsible for obtaining any necessary business licenses or permits required for vending at the event.

5. Health and Safety

  • General Conduct: Vendors must maintain a clean and safe environment in their booth area at all times. Vendors are responsible for removing waste and packaging materials from the event space.

  • COVID-19 & Health Protocols: If applicable, vendors must adhere to any health and safety protocols (e.g., COVID-19 regulations) imposed by the event venue or local government. This may include mask mandates, social distancing, or sanitation measures.

6. Event Cancellation or Postponement

  • In the event of an unavoidable situation, such as a natural disaster or government-imposed restrictions, that forces the cancellation or postponement of the event, the Vendor agrees that they will not hold Auckland Card Show liable.

  • Refunds: In the case of event cancellation or postponement, the Organizer will provide a refund to the Vendor, less any administrative fees. If the event is rescheduled, vendors will have the option to transfer their booth to the new date.

7. Conduct and Behavior

  • Vendors must conduct themselves in a professional and courteous manner during the event. Disruptive behavior, harassment, or failure to comply with event rules and guidelines may result in immediate removal from the event, with no refund.

  • Prohibited Items: The sale of illegal or dangerous items, including but not limited to weapons, drugs, and counterfeit products, is strictly prohibited.

8. Payment Terms and Refund Policy

  • Vendor Fees: The vendor fee is due upon confirmation of booth space and must be paid in full by the agreed deadline. Failure to pay by the deadline may result in the forfeiture of the booth space.

  • Refund Policy: Vendor fees are non-refundable except in the case of event cancellation or rescheduling. If the Vendor withdraws from the event for any reason, no refunds will be issued.

9. Force Majeure

Neither party will be held responsible for failure to fulfill their obligations under this Agreement in the event of circumstances beyond their reasonable control, including but not limited to, acts of God, fire, flood, war, government restrictions, or pandemics.

10. Miscellaneous

  • Amendments: These terms and conditions may be amended by the Organizer at any time. Vendors will be notified of any significant changes.

  • Governing Law: This Agreement is governed by the laws of New Zealand, and any disputes will be resolved in New Zealand courts.
